Tacopina informed CNN’s Don Lemon in a 2018 interview, “I can’t really talk about my impressions or any conversations we’d had because there is an attorney-client privilege that attaches even to a consultation.”
Lawyers in New York State are restricted by law from disclosing any information or conversations about a client’s case, even if they eventually reject to represent them.
In this case, according to observers, Tacopina may exploit information gained from meetings he confessed they’d had to assist in boosting his new client’s case against her, a clear violation of New York’s ethical standards.
The former federal prosecutor Michael McAuliffe said, “If an attorney had even preliminary but protected communications with Ms. Daniels about the Trump payment matter, that attorney would very likely have a conflict of interest in later representing Trump in the same matter or involving the same issues. The attorney could not ethically use any information obtained during privileged communications against a former client.”
He added that Tacopina would need help explaining how he can not reveal his prior discussion with Ms. Daniels because the attorney-client privilege protects them.
However, Tacopina can know the information from Daniels and still represent Donald Trump. The two assertions appear incompatible under the ethics rules and using common sense.
Tacopina’s law firm spokesperson contested the allegation, insisting that Tacopina never met with Daniels.
He explained that there was no conflict and there was no attorney-client relationship. Tacopina neither merged Stormy Daniels nor investigated her documents.
